Adults are skilled at using language to construct/negotiate identity and to signal affiliation with others, but little is known about how these abilities develop in children. Clearly, children mirror statistical patterns in their local environment (e.g., Canadian children using zed instead of zee), but do they flexibly adapt their linguistic choices on the fly in response to the choices of different peers? To address this question, we examined the effect of group membership on 7‐ to 9‐year‐olds' labeling of objects in (...) a trivia game, exploring whether they were more likely to use a particular label (e.g., sofa vs. couch) if members of their “team” also used that label. In a preregistered study, children (N = 72) were assigned to a team (red or green) and were asked during experimental trials to answer questions—which had multiple possible answers (e.g., blackboard or chalkboard)—after hearing two teammates and two opponents respond to the same question. Results showed that children were significantly more likely to produce labels less commonly used by the community (i.e., dispreferred labels) when their teammates had produced those labels. Crucially, this effect was tied to group membership, and could not be explained by children simply repeating the most recently used label. These findings demonstrate how social processes (i.e., group membership) can guide linguistic variation in children. (shrink)

To help infer the meanings of novel words, children frequently capitalize on their current linguistic knowledge to constrain the hypothesis space. Children's syntactic knowledge of function words has been shown to be especially useful in helping to infer the meanings of novel words, with most previous research focusing on how children use preceding determiners and pronouns/auxiliary to infer whether a novel word refers to an entity or an action, respectively. In the current visual world experiment, we examined whether 28‐ to (...) 32‐month‐olds could exploit their lexical semantic knowledge of an additional class of function words—prepositions—to learn novel nouns. During the experiment, children were tested on their ability to use the prepositions in, on, under, and next to to identify novel creatures displayed on a screen (e.g., The wug is on the table), as well as their ability to later identify the creature without accompanying prepositions (e.g., Look at the wug). Children overall demonstrated understanding of all the prepositions but next to and were able to use their knowledge of prepositions to learn the associations between novel words and their intended referents, as shown by greater‐than chance looks to the target referent when no prepositional phrase was provided. Apart from the names of Jan Baudouin de Courtenay (1845-1929), Mikołaj Kruszewski (1851-1887), and, later, Jerzy Kuryłowicz (1895-1978), Polish linguists and Polish linguistics generally have been little known in the West. The first two were mentioned with approval by Saussure in an unpublished paper, and this reference was picked up by Roman Jakobson and others many years later. Kuryłowicz, for his part, made himself well known in the West through his important work as Indo-Europeanist, even Semiticist, and as a general (...) linguist. The present volume is a first attempt to broaden the perspectives on the Polish contribution to linguistics both inside and outside of Poland during the past centuries. Specialists in their respective fields contributed chapters on the origins and development of general linguistics (Z. Wąsik), applied linguistics (F. Grucza), lexicology (T. Piotrowski), dialectology (St. Gogolewski), and onomastics (S. Gala), followed by five chapters presenting the theories of the arguably most remarkable Polish linguistic thinkers, from Baudouin de Courtenay (A. Adamska-Sałaciak), Kruszewski (F. M. Berezin), and Kuryłowicz (W. Smoczyński) to Mikołaj Rudnicki (1881-1978) and Ludwik Zabrocki (1907-1977) (both written by J. Bańczerowski). The growth of knowledge and its effects on the practice of medicine have been issues of philosophical and ethical interest for several decades and will remain so for many years to come. The outline of the present volume was conceived nearly three years ago. In 1987, a conference on this theme was held in Maastricht, the Netherlands, on the occasion of the founding of the European Society for Philosophy of Medicine and Health Care (ESPMH). Most of the chapters of this (...) book are derived from papers presented at that meeting, and for the purpose of editing the book Stuart Spicker, Ph. D., joined two founding members of ESPMH, Henk ten Have and Gerrit Kimsma. The three of them successfully brought together a number of interesting contribu tions to the theme, and ESPMH is grateful and proud to have initiated the production of this volume. The Society intends that annual meetings be held in different European countries on a rotating basis and to publish volumes related to these meetings whenever feasible. In 1988, the second conference was held in Aarhus, Denmark on "Values in Medical Decision Making and Resource Allocation in Health Care". In 1989, a meeting was held in Czestochowa, Poland, on "European Traditions in Philosophy of Medicine. From Brentano to Bieganski". Güvenilirci (reliabilist) bilgi teorisi, çağdaş epistemik gerekçelendirme kuramları içerisinde, dışsalcı (externalist) kuramın bir türü olarak kendisine yer bulmaktadır. Kısaca, bir inancı gerekçelendiren şeyin o inancın oluşturulduğu sürecin güvenilirliği olduğunu öne süren bu yaklaşım, bu bilişsel süreçleri özne dışı unsurlara bağladığı içinde dışsalcı bir pozisyonda yer almaktadır. Bu bilgi teorisinin tam karşı konumunda yer alan içselci (internalist) bilgi teorisi ise, özne merkezli bir yaklaşımla, doğru inancı gerekçelendirecek yöntemin, kişinin kendi zihinsel yapısından yola çıkarak, belli kognitif süreçler sonucunda ulaşılabileceğini öne sürmektedir. Epistemik (...) gerekçelendirme kuramları içerisinde birçok tartışmada kendisine yer bulan bu iki bilgi teorisi, kendi içerisinde de birçok farklı kurama kapı aralamıştır. A partir de son apparemment étrange observation d'une influence cachée des étoiles sur l'action humaine une attentive reconsidération du concept de l'actus humanus de Saint Thomas dans la Prima Secundae révèle une vue plus ample des processus internes à l'agent humain qui contribuent à la spécification individuelle de l'action humaine et, donc, de la liberté humaine. Il semble que parmi les adeptes de la théorie thomiste de l'action, l'influence importante que l'appétit sensible peut exercer en cette direction, tout en restant (...) entièrement caché aux actes conscients de l'intellect et de la volonté de la personne, n'a pas été reconnue jusqu'aujourd'hui. Provider claims to conscientious objection have generated a great deal of heated debate in recent years. However, the conflicts that arise when providers make claims to the "conscience" are only a subset of the more fundamental challenges that arise in health care practice when patients and providers come into conflict. In this piece, the author provides an account of patient-provider conflict from within the moral tradition of St. Thomas Aquinas. He argues that the practice of health care providers should be (...) understood as a form of practical reasoning and that this practical reasoning must necessarily incorporate both "moral" and "professional" commitments. In order to understand how the practical reasoning of provider should account for the needs and commitments of the patient and vice versa, he explores the account of dependence provided by Alasdair MacIntyre in his book Dependent Rational Animals. MacIntyre argues that St. Thomas’ account of practical reasoning should be extended and adapted to account for the embodied vulnerability of all humans. In light of this insight, providers must view patients not only as the subjects of their moral reflection but also as fellow humans upon whom the provider depends for feedback on the effectiveness and relevance of her practical reasoning. The author argues that this account precludes responsive providers from adopting either moral or professional conclusions on the appropriateness of interventions outside the individual circumstances that arise in particular situations. The adoption of this orientation toward patients will neither eradicate provider-patient conflict nor compel providers to perform interventions to which they object. But this account does require that providers attend meaningfully to the suffering of patients and seek feedback on whether their intervention has effectively addressed that suffering. (shrink)

M. Oaksford and N. Chater presented a Bayesian analysis of the Wason selection task in which they proposed that people choose cards in order to maximize expected information gain as measured by reduction in uncertainty in the Shannon-Weaver information theory sense. It is argued that the EIG measure is both psychologically implausible and normatively inadequate as a measure of epistemic utility. The article is also concerned with the descriptive account of findings in the selection task literature offered by Oaksford and (...) Chater. First, it is shown that their analysis data reported in the recent article of K. N. Kirby is unsound; second, an EIG analysis is presented of the experiments of P. Pollard and J. St. B. T. The authors explore the causes and consequences of fundamental changes which occurred during the formation of the network component of the national economy of China in 2010-s and explain the significant successes that the People’s Republic of China has achieved in the global high-tech market, taking into account the specifics of political situation in the country and its influence on the foreign economic policy of the Celestial Empire. This article revisits the hope of the First and Fourth Missiological Institute (MI) consultations in 1965 and 1967 regarding the survival of African Spirituality as relevant to the daily life of South African churches. African Spirituality has played a significant role in the cultural context of Africans. In the African context, African Spirituality is intertwined with life, death, and health, which co-exist with material aspects and the economy as gracious gifts from God. The churches in South Africa and elsewhere in (...) Africa have been challenged by the African worldview of healing and culture. Thus, Africans mostly prefer the African-centred church with more African Christianity, instead of Western Christianity. This has been a serious challenge in African church circles for centuries, even in the current 21st century. The question therefore arises whether this is a matter for the Africanisation, indigenisation, and decolonisation of the church in Africa. CONTRIBUTION: The article analyses the two MI consultations and whether the church in the 21st century has Africanised and decolonised itself in service of its African members. The study is a historical approach given the history of the MI's contribution in South Africa. The concept of African Spirituality is unpacked and contextualised within the African Independent Churches' (AIC) Zionist type churches such as the Zion Christian Church (ZCC), the St John's Apostolic Faith Mission (AFM), and other Ethiopian type churches such as Lutheran Bapedi Church and others in South Africa and African Traditional Religions (ATR). Fulford (bio)I am grateful to John Sadler and his colleagues for their generous invitation to contribute to this collection marking Philosophy, Psychiatry, & Psychology (PPP)'s thirtieth birthday. True to our editorial tradition of "no nonsense" publishing, the "ask" was a reflection on PPP's past, present and future, limited to 500 words. In fact, one word does it (...) for me—collegiality.Collegiality was our watch word from the start. I still treasure a group photo taken at an early pre-meeting of the Association for the Advancement of Philosophy and Psychiatry (AAPP) convened by Michael Schwartz at his home in 1992, when, among other initiatives, PPP was conceived through transferring our then-nascent journal proposal from a small British publishing house to its current international publisher, the Johns Hopkins University Press. Michael and I had met earlier by phone when he had called the Royal College of Psychiatrists in London to enquire about its recently launched Philosophy Group and (by mere chance) I happened to be standing next to the person who took the call! PPP, with John and myself its founder editors, was subsequently born as, and has remained, a joint venture between our two groups: and Peter Zachar's recent initiative in building closer links with the International Network for Philosophy and Psychiatry (INPP) has taken us an important step towards the vision shared by Michael, John and myself that PPP should grow to reflect and represent a global open society of philosophy and mental health.As a pointer to the future, this global open society was no mere utopian vision but a joint commitment to what we conceived as a necessary ambition. Contemporary disenchantment with the repeated failures of translation of current narrowly empirical models of psychiatry, points to the truth of our German colleague, Paul Hoff's, characterization of the history of psychiatry as a history of serial collapses into single message mythologies. This disenchantment might seem to offer an opportunity for colonial expansion of philosophy into psychiatry (a re-assertion, perhaps, of phenomenology?). But PPP was born out of the "decade of the brain" and has remained throughout an ally of, not competitor to, the neurosciences. [End Page 3] So, while it is true that, with Peter's initiative, and with editorial and other innovations introduced by John, PPP is actively extending its reach (to new areas of philosophy, and to new voices, informed notably by experience as well as by training), this expansion remains a collegial not colonial enlargement of the field. I need hardly point to the challenges presented by the inclusive ambitions of such enlargement (not least to maintaining the highest standards of editorial and peer review). But PPP's collegiality provides the foundation for the work needed to deliver on these challenges. Blue Cross & Blue Shield of Kansas ), the United States Court of Appeals for the Tenth Circuit upheld Blue Cross/Blue Shield of Kansas's anti-assignment requirement, on the grounds that the Employee Retirement Income Security Act preempted a hospital's claim against Blue Cross. The court also held that public policy supported anti-assignment requirements in health plans not covered under ERISA.When drafting ERISA, Congress did not explicitly address assignability of health care benefits. According to (...) the court of appeals, congressional silence constituted an intent to allow the parties to negotiate freely the assignment of health care benefits. Examining non-ERISA health plans, the court adopted a balancing test to determine the validity of anti-assignment clauses; it found that anti-assignment requirements promote freedom of contract and may include medical costs. The article is devoted to the analysis of features of functioning of the digital government in the Chinese State in the first decades of the 21-st century and the perspectives of its further development. In this work the authors give a brief description of the essence of phenomenon of digital government in general. The article explores the specific features of this process in the People’s Republic of China in the third millennium. This research examines the influence of functioning of e-government (...) bodies in Сhina on the internal political situation in the country – taking into account such aspects as building a dialogue between authorities and society, perfection of the public service system providing the Chinese citizens with essential public goods, the merits and the demerits of China’s online government are taken into account. This article examines such significant factors in the development of e-government in China as the impact of the global situation at the present stage on international politics and the country’s information security system. This article analyzes the features of the relationship between the Chinese authorities and media corporations operating on the Internet market of the Middle Kingdom, and studies the reasons for the contradictions between them. The study also comprehended strategy of the authorities of the People’s Republic of China in matters of information security of the state, including the active use of Chinese hackers in network conflicts with Western countries, and the actions of special units of the Chinese armed forces created to counter foreign cyber terrorism. The volumes are commemorative both in the sense of being a tribute to Aquinas and in the sense of being largely studies of his philosophical and theological writings. The studies are divided into seven sections: The Life of St. Thomas, The Writings of St. Thomas, Exegetical Studies, St. Thomas and His Predecessors, St. Thomas and His Contemporaries, St. Thomas in History: 14th to 19th Centuries, (...) and St. Thomas in the 20th Century. The historical character of these basic divisions reflects the generally historical character of the studies. Most of the studies also reflect the theological character of Aquinas’s own work in that they place the thought of Aquinas in the context of some theological tradition or dispute. (shrink)

Thinking is a dynamic process resulting from practices of integration. Thought encounters in openness, wonder, receptivity, and contemplation confer upon us intellectual work that is uniquely our own. Digital patterns, however, distract us from these creative encounters. Our intellectual searching is weakened and fragmented by frenetic consumption of information. We miss out on reason's innate pull toward integration and concrete reality. This book is an invitation to enter into openness, wonder, receptivity, and contemplation with deeper understanding and intentionality. We can (...) do this by considering exemplars, persons who lived out the integrity of their hard-won beliefs, such as Thomas Merton, Eva Saulitis, Malcom X and St. Anselm. Each process of integration is applied also, so that practical knowledge and practice become a way into this intellectual restoration. We need deeper knowledge won in the slow orbit of encounters. Encounters in thought are precisely what each generation needs to apprehend the cosmos, nature, authority, truth, and moral action. Responsibility to this ecologic age requires a reform of reason; this book is just one attempt to convey a way toward this restoration. (shrink)

On the basis of the archival materials, first identified by the authors, and the published historical sources that have not yet come to the attention of historians of science, this article reconstructs the biography of Johann Christian Weltzien (1767–1829), doctor of medicine and surgery. In 1785, Weltzien became a court physician. In 1799, in the retinue of Grand Duke Konstantin Pavlovich, he participated in Italian and Swiss military campaigns. After that, Weltzien was assigned to the Сourt of Grand Duke Konstantin (...) Pavlovich of Russia and stayed at his court until 1810. He started his charitable activities in the Medico-Philanthropic Committee. From May 1810 to the middle of 1825, Weltzien was a physician at the Imperial Page Corps. It turned out that around the same time, in 1804–1825, he was a member of the Medical Council. Furthermore, as there were two medical councils under two ministries at the time, in 1811–1822, he was a member of both. Since 1825, Weltzien lived on his estate in Somel, now Vaiatu Manor in Estonia, and died in St. Petersburg. Weltzien’s work as a provincial physician prompted him to write a book on medical police, which was published in 1785. It has been established that this remained his only book on the topic. The article shows that Weltzien became one of the first ideologists of state care for public health in the Russian Empire. Weltzien’s ideas, expressed over 200 years ago, regarding the state having mechanisms to impact public health and the importance of not excluding it from solving health problems have not lost their significance even today. This paper explores conflations of martyrdom, spectatorship, and image theory in Caravaggio’s Crucifixion of St. Peter (1601). It argues that Caravaggio employs an “iconic” visual formula as a response to the pressures of a post-Tridentine poetics. Through these strategies, an iconography of immediacy and presence is paired with a sacrificial subject-matter. This merging united witness and visual experience in the shape of the sacred image. Martyrdom, as both a historical and representational phenomenon of early modern sociality and culture, invoked the (...) act of spectatorship. In connecting the Crucifixion of St. Peter with the cultural and aesthetic paradigms of post-Tridentine Italy, the article argues that Caravaggio’s image re-imagines the codes of iconic repre­sentation. While not a novel academic context for Caravaggio scholarship, I will read this image less as the expression of stylistic tensions in the Roman artworld than as the result of overlapping frameworks—martyrdom, Petrine iconography, and a Counter-Reformation aesthetic. Reenergized as part of the visual rhetoric of Tridentine politics, the icon reflected a new propensity for paleochristian cultural revival. Discussing both the contextual pressures of this new aesthetic regime as well as intertwining it with the increasing presence of Catholic image treatises, the article suggests an “iconic” space for reading Caravaggio’s Crucifixion. This “iconic” framework is built into the charged discourse surrounding the image itself. (shrink)

In this paper we present the standard Thomistic view concerning substances and their parts. We then note some objections to that view. Afterwards, we present Aquinas’s Christology, then draw an analogy between the relation that holds between the Second Person and the assumed human nature, on the one hand, and the relation that holds between a substance whole and its substance parts, on the other. We then show how the analogy, which St. Thomas himself drew at points, is useful for (...) providing a theory that answers the objections that the standard Thomistic view faces. Finally we answer objections to our approach. We conclude that there is a hylomorphic theory, founded on an analogy from Aquinas’s Christology, that fits well with the empirical data concerning substance parts, on which some complete created material substances have other complete created material substances as parts. No doubt, the later influence of many of the so-called nouveaux théologiens leading (...) up to, during, and following the Second Vatican Council has contributed to the continued currency of their thought and the debates connected to it. Numerous monographs continue to be written concerning themes of "ressourcement," theological reform, and engagement with the world, all of which were dear to many of those who were embroiled in the philosophical and theological controversies of the 1930s and 1940s. Moreover, increased interest in certain long-buried conservative Thomist thinkers from this same era has led to renewed consideration regarding the concerns that they expressed at the time. In fact, it would seem that today, in 2022, the evaluation expressed in Nineteenth Century Scholasticism: The Search for a Unitary Method by Fr. His Christian Ethics: A Very Short Introduction opens with a quote from Christopher Hitchens and later dedicates almost an entire chapter to analyzing the failures of Christian ethics. From the Crusades to colonialism, the Galileo affair to slavery, Long provocatively asks whether modern ethics emerges as a result of the failure of Christian moral claims. While not sidestepping the difficulties in Christian history, Long is careful to note how this history is often distorted to serve the goals of contemporary secular politics, goals which he points out have resulted in the bloody failures of the twentieth century. Perhaps a renewed interest in Christian ethics, Long notes, is a result of the failures of secularism.Long manages to cover a surprising breadth of material in his brief book, from a sweeping historical overview of Christian theology to a final chapter on [End Page 195] the practical matters of sex, money, and political power. Long also summarizes some important theological differences among Christians that lead to practical disagreements about the nature of Christian ethics. His overview of the Catholic-Lutheran convergence on matters of faith and works is particularly helpful in establishing the theological basis for an ecumenical Christian ethics. This historical survey serves to illustrate that ethics is both an integral part of and a contradiction to Christianity. Still, argues Long, while Christianity may claim to be more than ethical, it may never claim to be less.While commendable in breadth, the genre of the “very short introduction” precludes depth and must necessarily omit important information. In his summary of Catholic ethics, for example, Long addresses nominalism and probabilism but omits the Catholic social tradition, a particularly glaring omission given his topic. In the end, the target audience is the educated and curious layperson, more suitable for a church group than a classroom, though this is reflective of the nature of “the very short introduction” series and does not indicate any limitation in Long’s skill as a scholar.In the spirit of brevity, Michael Banner, Fellow of Trinity College in Cambridge, offers Christian Ethics: A Brief History, which, like any brief history, paints with broad and admittedly selective strokes. The aim of this work is not to evaluate the normative value of Christian claims but rather to establish the ethical implications of Christian belief. Unlike Long, who directly addresses the ethical failures of the church, Banner is more apologetic. In clarifying the difficulties of writing a text such as this one, he observes that Christian history has not been guided by texts as much as by action. In this vein, Banner begins not chronologically but with the Rule of St. Benedict and its call to live in a relationship with God and neighbor characterized by love.Banner grounds the theoretical dimension of Christian ethics in this emphasis on practice. Given the way of life Christians are called to, what are its limitations and possibilities? Banner turns to Augustine’s notion of the weakness of the will and the human creature’s need for grace, which he then places in creative tension with Aquinas’s emphasis on the harmony between faith and reason. This article addresses the fiduciary issues raised by the current practice of plan fiduciaries of not only disclaiming any fiduciary responsibility for brokerage window investments, but also abdicating any role (fiduciary or otherwise) in assessing even the general suitability of those investments for a retirement plan, and concludes that the practice is in plain and notorious violation of what ERISA requires of fiduciaries.

This presentation of scientific methodology tries to avoid metaphysical issues without being unphilosophical. Drawing from a wide range of material, the book describes clearly but rather generally what empirical scientists are concerned with, how they proceed, what they accomplish. The five parts deal with the roles in science of definitions, physical laws and theories, induction, and the interplay of reason and immediate experience. Despite the slant indicated by the many quotations from St. Thomas and Aristotle--peculiarly but pleasantly combined with passages (...) from Einstein, Schrödinger, de Broglie, Eddington, etc.--a rather objective presentation is achieved.--L. Proactive policing strategies produce a range of harms to African Americans in poor urban communities. We know little, however, about how aggressive policing is experienced across gender by adolescents in these neighborhoods. The authors argue that important insights can be gained by examining the perspectives of African American youths and draw from in-depth interviews with youths in St. Louis, Missouri, to investigate how gender shapes interactions with the police. The comparative analysis reveals important gendered facets of African American adolescents' experiences (...) with and expectations of law enforcement. Young men described being treated routinely as suspects regardless of their involvement in delinquency and also reported police violence. Young women typically described being stopped for curfew violations but also expressed concerns about police sexual misconduct. This study highlights the differential harms of urban policing for African American young women and men and highlights the need for systematic attention to the intersections of race and gender in research on criminal justice practices. Objective: To study the preferences of patients for information related to elective procedures.Methods: A survey was carried out using a sample of 187 women. The majority of whom were on a low-income, who obtained obstetric or gynaecological services at St Joseph Regional Medical Center in Milwaukee, Wisconsin, while they were in a waiting room.Results: Many of the complications, including those that are uncommon and less serious, were considered to be relevant to the medical decisions of most patients. Average seriousness ratings (...) associated with complications of various elective procedures were in the range of moderate to high. A frequency of complications of 1:100 or higher would factor into most women’s elective treatment decisions. Women indicated a preference for receiving as much or more information pertaining to complications associated with particular elective obstetric or gynaecological procedures as other elective procedures.Conclusion: Most women wish to be informed of risks and treatment alternatives, rate many complications as serious, and are likely to use information provided to make elective treatment decisions. This article inverts Donna Haraway’s proposition that ‘the ideologically charged question of what counts as daily activity, as experience, can be approached by exploiting the cyborg image’ by instead exploiting everyday experience to approach the contemporary cyborg. It utilises digital tools to compile a corpus of Instagram posts that foreground corporeal hybridity, and examines this social media data through the lenses of feminist STS, affect theory and digital studies. This strategy offers a new vantage on the cyborg by connecting it (...) to concrete and ongoing user practices. To make these interventions, this project focuses specifically on a genre of post popularised by Instagram fitness (or fitstagram) influencers – diptych photographic montages that oppose imperfectly ‘real’ material bodies to unrealistically ‘perfect’ media bodies. Although they formally rely on binary logics (real v. perfect, offline v. online), the posts simultaneously deconstruct them in a number of ways. These repeated boundary transgressions reflect users’ lived experiences of hybrid online/offline corporeality and help forward a theory of cyborg embodiment that relies on quotidian practices as opposed to fixed products or identities. Moreover, close engagement with a final dataset of eighty-nine posts illuminates three particular modes of enacting the cyborg corpus on Instagram: occupation of multiple bodies, awareness of the analogue body and anxious boundary-work. This research extends the cyborg as a critical figure by situating it within a social media context, attending to its imbrication in everyday practices, and affirming female Instagram users as theorists of their cyborg selves. The Dictionary is planned as a handbook for modern students on the model of the Plato Dictionary and the Aristotle Dictionary and concentrates on the interests of modern studies in philosophy and theology. Hence terms like Analogy of Being, Participation, Act, Potency, Matter, Form, Person, Individuation, and the other central notions of Thomistic Philosophy receive scant treatment. Similarly theological terms like Incarnation, Trinity, Redemption, and (...) Supernatural are omitted. MinerdAmong the various types of law discussed in St. Thomas's theological "treatise on law"—questions 90–108 of Summa theologia [ST] I-II—the classification known as the "law of nations" (ius gentium) holds an ambiguous epistemological position. Marking a kind of halfway point between the natural law and civil law, it seems to straddle both domains. In fact, in a particularly important text dedicated (...) to this topic in the ST (I-II, q. 95, a. 4), Aquinas classes the ius gentium as being closely connected to the natural law, though in a way that is somewhat derivative, not as immediately flowing from human nature (especially in its animality) as does the natural law, but also not as marked by human contingency as is human civil law.As was recently discussed in a well-documented and insightful article by Barrett H. Turner in The Thomist, there have historically been two main lines of Thomist interpretation concerning the exact character of the "law of nations." Very broadly stated, what he refers to as the "Salamancan" line, indebted to Francisco de Vitoria, "interprets Thomas's doctrine of the ius gentium as a body of universal positive institutions (that is, specifications, determinationes) added to the natural law by agreement of the human race."1 [End Page 1043] This position, which would be common for several centuries among members of the Thomist school, would locate the law of nations essentially in the domain of nearly universally adopted customs and institutions, not strictly deduced from the natural law, but rather grounded on "the quasi-political authority of the entire human race, which promulgates the ius gentium by customs whose utility for attaining the ends of the natural law under a certain set of social conditions is easily recognized by rational creatures."2Turner calls the other line of thought "Maritain's Neo-Thomist Line,"3 an outlook that would be shared with various nuances by thinkers like Jean-Marie Aubert, Yves Simon, Marie-Michel Labourdette, John Finnis, and others. Setting aside my qualms about his appellation "neo-Thomist," which does more to obscure than to illumine (for it covers a host of Thomistic figures who have significantly different views on what constitutes "Thomism"), Turner does fairly lay out the major lines of Jacques Maritain's position, which is most directly articulated in Man and the State and La loi naturelle ou loi non-écrite.4 Basing himself on his particular view of knowledge of the natural law through connaturality,5 Maritain contrasted this sort of moral cognition with that which develops in the line of conceptual articulation, thus having a different "gnoseological" character from our knowledge of the natural law, while nonetheless still sharing the same "ontological" foundation. Such conceptually articulated law would be the ius gentium.Rather than add my voice to the dialectic of the various thinkers arrayed by Turner into the two aforementioned camps, I would like to propose a slightly different approach to the "moral epistemology of the law of nations," though one that I believe lies in line with the best aspects of Maritain's approach. Continuing a series of reflections that I have undertaken [End Page 1044] concerning moral epistemology during the past few years,6 I propose that it is most helpful to consider the "law of nations" as being a form of reasoning pertaining to what Scholastic vocabulary would refer to as "moral science,"7 namely discursive philosophical reasoning concerning the essences, properties, effects, and various other essential relationships that belong to a human acts, morally considered (the principal subject of moral philosophy), along with other subjects that are studied in relation to this principal subject (e.g., the principles of human acts, most particularly, the structure of human acts and the moral virtues).
